1.0 – Introduction
- Cloud4Sea Sdn. Bhd. (collectively referred as “us”) and its affiliated product (collectively referred to as “AI Coolbinet”) provide website features which can be found at https://cloud4sea.com/ai-coolbinet/ and other products and services to you (collectively “Customers”, referred as “you”) when you visit. AI Coolbinet mobile application (“AI Coolbinet App”); or use software provided by AI Coolbinet with any of the foregoing (collectively, “AI Coolbinet Services”)
- These Terms and Conditions (“T&C”) govern your use of AI Coolbinet Services and your relationship with Cloud4Sea. We welcome customers to use AI Coolbinet Services for entry into our unmanned stores (“AI Coolbinet”). It is important that you go through these T&Cs and understand them before registration. This set of T&Cs will help you to understand how AI Coolbinet operates and ensures that we serve you fairly and properly. Only customers with a verified account are able to make purchase on AI Coolbinet. We highly encourage you to download the AI Coolbinet App through Apple or Google Play Store to enjoy a seamless shopping experience.
2.0 – Acceptance of These Terms and Conditions
- Please read these T&Cs carefully. By clicking “I Agree” on the registration page, you agree to these T&Cs, and you consent to the collection, use, and disclosure of your personal data as described in these T&Cs. If you do not agree to these T&Cs, you must discontinue the use of AI Coolbinet Services. These T&Cs shall be effective upon your acceptance by clicking “I Agree”. Your use of AI Coolbinet Services shall be deemed to be your agreement to be bound by each of the terms set forth herein.
- Cloud4Sea reserve the right to modify, update, replace or change any or all of these T&Cs or its policies relating to the Services at any time. Any modification, update, replacement or change to the T&Cs or any of its policy relating to the Services shall be effective upon posting of the updated version. It is always a good practice to review the T&Cs of any website or service you use regularly. T&Cs may change over time and it’s important that you stay informed about any updates by reviewing the T&C regularly. If any modification is unacceptable to you, you shall cease from using AI Coolbinet App Services and accessing it immediately. If you do not cease from using AI Coolbinet App Services, you will be hereby deemed to constitute your agreement to and acceptance of such changes.
- You are expected to check these T&Cs from time to time to take notice of any updates, enhancements, new features or changes Cloud4Sea has made as they are binding on you.
3.0 – Account Registration
- To use our AI Coolbinet, you must first establish an account with Cloud4Sea via the AI Coolbinet App. Registration provides a unique identification for and allow us to trace any order in event of queries.
- Registration must only be done by individuals who can form a legally binding contracts under Malaysia’s Section 2 of the Age of Majority Act 1971; which must be at least 18 years of age; and are not barred from using AI Coolbinet Services under any applicable laws.
- To register for an account, you must provide a valid phone number and particulars of your payment method. Additional identification information may be required in compliance with e-KYC. Your account is tagged directly to your AI Coolbinet App and all purchases will be caged to the payment method which you have linked to your account.
- You are responsible for: (i) maintaining the security and confidentiality of your account; (ii) restricting other people access to your account; (iii) be responsible for any purchases and activities that are submitted under your AI Coolbinet App account (iv) ensuring that all details provided during registration or any other time are correct and complete.
- You agree to immediately notify Cloud4Sea of any unauthorized use of your account or any other breach of security by contacting us via the Customer Support number or email located in this T&C under section 20.0.
- Cloud4Sea reserves the right to refuse, suspend or terminate registration of any account and/or the use of AI Coolbinet Services at any time for any reason, including and not limited to the following:
i. accounts of Customers that have been dormant for more than 180 days; and
ii.accounts of Customers that we suspect have been compromised or used in breach of these T&Cs.
- You acknowledge and agree that Cloud4Sea may, to the extent permitted by applicable laws, access, preserve, and/or disclose your account information, all communications to and from you and all information relating to your use of AI Coolbinet Services, if Cloud4Sea is required to do so by law or legal process or if Cloud4Sea determines, in its sole discretion, that such action is necessary to protect the rights of Cloud4Sea, third parties, and other users of AI Coolbinet Services or for purposes of responding to your request for customer service.
4.0 – Intellectual Property
- You acknowledge that AI Coolbinet App Services contains information, data, software, photographs, graphics, typefaces, music, sounds and other material (collectively “Content”) that are protected by copyrights, trademarks, database and other intellectual property rights owned by us or our appointed suppliers.
- You shall not modify, reproduce, copy or distribute any of the Content on AI Coolbinet Services for commercial purposes without our prior written consent. Any violation of the licenses or privacy policies shall constitute a breach of the Terms and Conditions.
5.0 – Restrictions on Use Of AI Coolbinet Services
- You may access and use AI Coolbinet Services only in accordance with all applicable laws and regulations and with these T&Cs. You acknowledge and agree that Cloud4Sea, in its sole discretion and without notice or any further obligation to you, may temporarily suspend or permanently discontinue and refuse any and all current and future, access to or use of AI Coolbinet Services. You further agree that you will not use AI Coolbinet Services for any or all of the following purposes:
- Disseminate material that encourages conduct that constitutes a criminal offence or results in civil liability or otherwise breaches any relevant laws, regulations or code of practice;
- Gain unauthorized access to other computer systems;
- Interfere with any other person’s use of AI Coolbinet Services;
- Interfere or disrupt networks or web sites connected to AI Coolbinet Services;
- Make, transmit or store electronic copies of materials protected by copyright without written permission of Cloud4Sea;
- Resell or make commercial use of AI Coolbinet Services or content therein;
- Modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works of, transfer, or sell any content;
- Collect or use any product listings or descriptions;
- Using any data mining, robots, or similar data gathering and extraction methods from AI Coolbinet Services;
- Other than for your use of AI Coolbinet Services as expressly permitted in these T&Cs, access or attempt to access any systems or servers on which AI Coolbinet Services are hosted or modify or alter AI Coolbinet Services in any way;
- Forge headers, create a false identity or otherwise manipulate identifiers in order to deceive others or disguise the origin of any content or other information transmitted to or via AI Coolbinet Services;
- Use, frame or utilize framing techniques to enclose any trademark, logo or other proprietary information of Cloud4Sea (including the images found on AI Coolbinet Services, the content of any text or the layout/design of any page or form contained on a page) without Cloud4Sea’ express written consent;
- Use any meta tags or any other “hidden text” utilizing a name, trademark, or product name of Cloud4Sea without Cloud4Sea’ express written consent.
- Any unauthorized use of AI Coolbinet Services will terminate the permission or license granted by these T&Cs and will result in you being barred from use of AI Coolbinet Services.
6.0 – Personal Data Protection Policy
Cloud4Sea Sdn. Bhd. respects its commitment to the protection of their customer’s personal information and their privacy. This Personal Data Protection Act document explains how we collect and handle your information in accordance with the Malaysian Personal Data Protection Act 2010. Please note that Cloud4Sea may amend this Personal Data Protection Notice at any time without prior notice and it is recommended that you should always review it regularly.
6.1 – Type of Personal Information Collected by Cloud4Sea
- Cloud4Sea collects personal information, which is defined as any information related to you and collected or provided to Cloud4Sea for the purposes stated in section 6.4 below.
- Your personal information may include your full name based on what is stated in your IC / Identity card, NRIC number, contact number, GPS information and payment method information.
6.2 – Source of Personal Information
- Customer or potential customer: Cloud4sea collects your personal information directly via;
- Application and/or registration forms when you register through our AI Coolbinet App,
- Refund/Return Request Form
- Contact Us section
6.3 – Obligatory Personal Information
All information requested in the relevant forms in obligatory to be provided by you unless stated otherwise. Failure to provide the required information may result in an inability to process your request or provide you with AI Coolbinet services and in-app features.
6.4 – Purposes of Collecting Your Personal Information
- Your information is collected and further processed by Cloud4Sea as required or permitted by law and to give effect to your requested commercial transaction commercial transaction, including the following:
- To facilitate your participation in any contests or events,
- To communicate with you in relation to our services and/or events,
- To process any payments related to your requested service and transaction,
- To conduct internal marketing analysis of customer patterns and choices
- To contact you regarding products, services, upcoming events, promotions, advertising, marketing and commercial materials which may interest you,
- To ensure that the content from our website is presented in the most effective manner for your mobile or computer devices,
- For Cloud4Sea’s internal records management
6.5 – Disclosure of Personal Information
6.5.1 – Entities within Cloud4Sea
- Your personal information provided to us is processed by entities within Cloud4Sea (including outsourcing partners).
- Cloud4Sea will ensure that;
- Access to your personal information is restricted to staff who are contractually required to process your personal information in accordance with their respective job.
- Only necessary information is released to the relevant staff.
6.5.2 – Classes of third parties
- Your personal information may be disclosed to relevant third parties (in or outside of Malaysia) as required under law, pursuant to relevant contractual relationship (for example, where we appoint third party service providers) or for the purposes stated in Section 6.4 written above (or directly related to those purposes).
- In the event of a potential, proposed or actual sale of business, disposal, acquisition, merger or re-organization (Transaction”), your personal information may be required to be disclosed or transferred to a third party as a result of the Transaction. You hereby acknowledge that such disclosure and transfer may occur and permit Cloud4Sea to release your personal information to the other party and its advisers/representatives.
- Your personal information may be disclosed to the following classes of third parties;
- Third parties appointed by us to provide services to us or on our behalf (such as lawyers, consultants, communications service providers, company secretary and professional advisors.)
- Law enforcement agencies, including the local police.
- Relevant governmental authorities statutory authorities, local council and industry regulators.
6.6 – Location enabled application
Our location-enabled application transmits your location information to us. We do not use the information sent or provided other than to provide the service you request. Location enable features are opt-in and you have control over your participation and can turn these services off at any time or uninstall them.
6.7 – Right to access and correct your personal information
You have the right to access and correct your personal information held by us (subject always to certain exemptions). We strive to maintain accurate and up-to-date personal information. Please update your information in the AI Coolbinet app or contact us directly if changes are needed.
6.8 – Limiting the processing of personal information, further enquiries and complaints
If you would like to (1) obtain further information on how to limit the processing of your personal information, (2) you have any further query, or (3) you would like to make a complaint in respect of your personal information, you may contact us at the information provided in section 20.0 below.
7.0 – Use of AI Coolbinet App
- AI Coolbinet App store and process personal data that you provide to us for the purposes outlined in our PDP Policy. It is your responsibility to keep your mobile device and access to AI Coolbinet App secure, including but not limited to the following: we do not recommend that you remove any software restrictions and limitations imposed by the official operating system of your mobile device (including but not limited to unlocking, rooting, and/or jailbreaking your device) as that could make your mobile device vulnerable to malware, viruses and other malicious programs, and that could also compromise your mobile device’s security features and compromise the proper functioning of AI Coolbinet App.
- You acknowledge that the availability of the AI Coolbinet Application is dependent on the third-party platform from which you download the Application (for example, Apple App Store or Google Play Store). Each of these platforms may have its own terms and conditions for the downloading, installation and use of the application, and you agree that it is your responsibility to ensure compliance with such terms and conditions.
8.0 – Limitation of AI Coolbinet Services
Whilst all attempts will be made to ensure AI Coolbinet App Services are available all the time, occasionally AI Coolbinet App Services may undergo repairs, maintenance or the introduction of new services which may render the unavailability of access to AI Coolbinet App Services.
9.0 – Third party Sites
- There may be occasions when information or materials on or of third parties are provided on AI Coolbinet Services.Cloud4Sea is not responsible for the content or activities of any other sites linked from and/or outside AI Coolbinet Services.
- Your visit or use of any third party site linked from AI Coolbinet Services is entirely at your own risk. A link to another website does not mean that Cloud4Sea endorses or accepts any responsibility for the content displayed on the other website.
10.0 – Product Information & Billing
- Whilst every effort is made to display your purchases accurately in terms of price and description of the product(s) on AI Coolbinet Services, errors may occur and we do not guarantee that the pricing, product description and/or promotional information provided on AI Coolbinet Services will be accurate, current, updated, or complete.
- Cloud4Sea takes great care to accurately display the colors of our products that appear on AI Coolbinet App Services. However, as the actual colors you see will depend on your screen or monitor, we cannot guarantee that your monitor’s display of any colour will be a true reflection of the actual colors of the products.
- In the event where there is a difference in price between your order made via AI Coolbinet Services and the final bill rendered, whether arising from substitutions, daily price changes, promotions, special price, mislabeling or mispricing etc, Cloud4Sea reserves the right to adjust the final bill even after the online bill is presented to you.
- Upon confirmation of transaction, customer will be provided with an online transaction receipt through the mobile app which customer can view at any time. It is advised that customer retains a copy of the transaction receipt by any means necessary apart from the one available within AI Coolbinet App.
11.0 – Promotions, Offers and Discounts
- Cloud4Sea may introduce promotions or offers from time to time for purchase of its goods and services, or a discount off the prevailing price of its goods and services, through the AI Coolbinet Application. Promotions shall only be effective for the applicable promotional period and on a “while stocks last” basis. Cloud4Sea reserve the rights to modify, cancel or discontinue them at any time, without any notice to you.
- Promotional codes or coupons (“Coupon”), if made available to you, are not transferable and not redeemable for cash. Each Coupon has its own qualifying terms. It is void where prohibited by law.
- In the event of suspected fraud or misuse of any Coupon or breach of the terms herein, we reserve the right to reject or cancel the use of a Coupon. We also reserve the right to charge you partially or in full the value of the benefit received using your payment method, without further notice to you.
12.0 – Return Policy
- Where you have purchased a defective product, you may get in touch with our Customer Service Representative in-app within an hour (60 minutes) from date of purchase via the following method:
- Select My Orders, followed by tapping on the order where the defective product was purchased.
- Scroll to the bottom of the page and select Click To Appeal.
- Provide the name of the product and describe the issue found.
- Tap on Submit. Our Customer Service Representative will get back to you as soon as possible.
- You may follow-up on your appeal by tapping on My Account, followed by Feedback.
- We also advise you to inspect any goods you purchase immediately to ensure your complete satisfaction with the product. Therefore, we recommend that you read our Return Policy which is located in Section 12.0 before making a purchase from our AI Coolbinet to familiarize yourself with our policy on refunds.
- If a customer requests a refund for a product that was purchased with a discount, voucher, or promotion applied, the refunded amount in the form of a cash voucher will not include the value of the discount, voucher, or promotion. This is because these discounts are applied to the original purchase price of the product and are not considered part of the product’s value. We apologize that we are unable to exchange medical and hygiene-sensitive items to ensure the safety and health of our customers. Additionally, please note that we do not allow exchanges for mistakenly purchased products.
- In the refunding process, you may be eligible for either a partial or full refund in the form of a cash voucher, depending on your request. Multiple factors may be considered by Cloud4Sea in the refunding process such as;
- overall condition of the refunded product,
- product timeline from customer buying it till it becomes defective,
- self vandalizing,
- use of any discount, voucher or promotional codes.
- All the factors mentioned above will be the determining factors for a partial or full refund process. Therefore, Cloud4Sea may require up to 7 working days to complete the entire process and issue the refund in the form of a cash voucher.
- During the 7-day period, Cloud4Sea may review all the information provided regarding the refunded product, verify the payment details of the original transaction, and process the refund in the form of a cash voucher. However, please note that delays may be due to weekends, holidays, or other factors that could impact the processing time.
- While 7 working days is the usual timeframe for processing a refund, please be aware that the processing time may vary depending on the circumstances. It is possible for the refund to be processed earlier or later than the standard timeframe. If you have any additional questions about this refund process, please feel free to contact us via the information given in section 20.0. Any decision by Cloud4Sea relating to promotions, use of Coupon and other rewards is final and binding.
13.0 – Payment
- Payment information is transmitted through a secure payment channel Secure Socket Layer (SSL). Payment for all purchases will be made to the payment mode which you have linked to your account.
- Cloud4Sea only accepts payment through VISA and MasterCard credit and debit. In order for customers to access the AI Coolbinet to make any purchases using their debit card, a per-authorization hold of RM200 will be placed on their account to verify that the card is active and has sufficient funds prior to the transaction. The hold will be released within 3-5 business days, subject to the policy of the respective bank, after completing the transaction with AI Coolbinet.
- Cloud4Sea reserves the right to change the mode or method of payment for products offered at any time by announcement through AI Coolbinet Service App, email blasts and any other means of communications.
14.0 – Security Capabilities and Policy for Transmission of Payment Card Details
- To minimize the risk of fraudulent card use, Cloud4Sea will only store and display a portion of the cardholder’s Card number known as masked card. Credit card information is entered and authorized solely on the page provided by the payment gateway and Cloud4Sea has no access to any of the user’s activities on this page provided by the payment gateway.
- The network transmission between the payment company and Cloud4Sea is encrypted using HTTPS.
15.0 – Warranties
- Cloud4Sea excludes all warranties, descriptions, representations or advice rendered as to the fitness or suitability for any purpose, tolerance to any conditions, similarity to sample, merchantability or otherwise of any product supplied in AI Coolbinet.
- No agent or representative of Cloud4Sea is authorized to make any warranty, representation or statements given as to the fitness or suitability for any purpose, tolerance to any condition, similarity to sample, merchantability or otherwise of any product supplied.
16.0 – Limitation of Liabilities
- Cloud4Sea shall not be liable for any consequential, indirect or special damages or loss of whatever arising. To the extent that Cloud4Sea is liable in contract, tort or otherwise for any loss, damage or injury arising directly or indirectly from any defect in or non-compliance of a product or any other breach of Cloud4Sea’ obligations hereunder, such liability shall not in any event exceed an amount equivalent to the price of the product(s) giving rise to such liability.
- Cloud4Sea will not be held responsible for any damages or loss of products after purchase. You shall not use our products in any manner and/or for any purpose for which they are unsuited for and shall be responsible for using all necessary skill and care in handling and using the products. You expressly agree that Cloud4Sea assumes no obligation or liability for any advice or information given with the products and Cloud4Sea assumes no responsibility for any inaccuracy or misstatement of any such information. You assume all risks connected with the use and storage of the products.
- You completely acknowledge and agree that you assume all risk in connection with the use of AI Coolbinet Services. Cloud4Sea shall not be liable for any direct, indirect, consequential or punitive damage arising from the use of, or access to AI Coolbinet Services. Without limitation to the foregoing, AI Coolbinet Services and all information contained herein is provided on a “as is” basis without any implied or express warranty including any implied warranty as to title, quality, merchantability, fitness for purpose, or non-infringement. Before acting on the information found on AI Coolbinet Services, you may wish to confirm the facts that are important to your decision making. Product information listed on AI Coolbinet Services may be different from information listed on the products for a variety of reasons including such things as manufacturers’ updates and changes. Cloud4Sea reserves the right to change or update information of any product on AI Coolbinet Services at any time without prior notice. Cloud4Sea shall not be liable for any error or omission in the content of AI Coolbinet Services including any damage or injury arising out of or in connection with any access or use of AI Coolbinet Services whether such damage/injury is caused by failure of performance, error, omission, defect, delay in operation, computer virus, theft etc.
17.0 – Termination
If you violate any of these T&Cs, your permission to use AI Coolbinet Services and/or your account may be suspended or revoked, and we reserve the right to suspend or terminate your access to, and use of, AI Coolbinet Services at any time.
18.0 – Governing Law and Dispute Resolution
These T&Cs shall be construed in accordance with the applicable laws of Malaysia. Depending on the nature of the dispute, any claim or disagreement arising out of or in connection with these T&Cs and/or use of AI Coolbinet (“Dispute”) shall be submitted to Cloud4Sea through contact information provided at section 20.0. If the Dispute cannot be resolved through the communication, interaction and negotiation between Cloud4Sea and their customer, such Dispute shall thus be referred to the competent courts of Malaysia, as the case may be, for resolution and adjudication.
19.0 – External Links
AI Coolbinet Application may contain links to other websites or applications. These links are for convenience only you understand that these links always carry some degree of risk, as they may lead to websites that contain viruses or scams. It’s always a good idea to be cautions when clicking on links. Cloud4Sea is not responsible for the availability or content of these sites or for any virus or other damaging elements encountered in linking to a third-party website or application.
